Litigation Support
For the environmental attorney, "Complex" and "Interdisciplinary" do not adequately describe your practice. You deal with an alphabet soup of Federal environmental laws: CERCLA, NEPA, RCRA, TSCA, CWA, and FIFRA. On top of that, in California, for example, add CEQA, the California Superfund Program, Hazardous Waste and Water Pollution Control, Pesticide regulations, Underground Storage Tank regulations, and all of the local City, County, and Regional regulations to contend with.

As an advocate for your client, you are in a constant tug-of-war, being pulled (or pushed!) in multiple directions by competing forces: your client's interests, the governmental regulatory agency's concerns or demands, opposing counsel's environmental attorneys, the opposition's consulting firm, and the insurance company attorneys representing each of the parties. This does not include the non-party stakeholders who are also at the table. You have to balance all these myriad interests along with the legal, equitable, and technical concerns in order to effectively represent your client.

To help manage at least the technical aspects of your environmental litigation, Gaston and Associates is there for you and your firm.

Data and their interpretation are the tangible foundation upon which a successful environmental case can be argued or defended. It follows then that a clear understanding of the facts underlying litigated environmental issues is paramount. In this regard, we work closely with counsel to identify the key points for effective representation, including case theory development, given the client's factual position. Having served both plaintiff and defense counsel in environmental litigation, we can help you understand the facts upon which your client's position rests and how best to accentuate or minimize favorable or unfavorable technical data. We can assess the technical merits of the complaint and incorporate this information into the overarching litigation strategy.
